There's nothing good about an accident that results in personal injury. Given the choice, most injury victims would forgo the money, and choose never to have had an accident. Accidents and their ensuing injuries can be stressful, and result in a detrimental impact on quality of life. While it may seem like a small consolation in terms of the overall negative experience of sustaining personal injury, New York does offer some attributes that are friendlier to the accident victim than other jurisdictions. For one, New York is a pure comparative negligence jurisdiction.
Additionally, the statute of limitations in New York is fairly liberal, at three years. While a few jurisdictions may exceed this, many states impose statutes of limitiations of one to two years in personal injury matters based on negligence. Statutes of limitations, the most inflexible and unforgiving aspect of personal injury litigation.
You can't sue City Hall. While everyone is familiar with that tired expression, the fact is that lawsuits against cities, municipalities, or public agencies generally have a few strings attached. The statutes of limitations are generally abbreviated (shorter and harsher than those normally applied in the state for other types of cases), and there are often requirements to file a notice of claim. So in a way, the expression has an element of truth to it... it is more difficult to sue public agencies.
