Maintenance & Cure...

Maintenance & Cure

In any injury setting, the remedies available to the injury victim are fairly similar across the board. There are economic damages, which are basically damages that you can put a price tag on with exact figures (lost wages, medical expenses, transportation to therapy, household help, etc.). There are also non-economic damages, where it is more difficult to take out a box of receipts. These include things like pain and suffering, mental anguish, loss of consortium, loss of affection, etc.
With injuries associated with the Jones Act (as a crewmember associated with a vessel or fleet of vessels), the claimant is entitled to "maintenance and cure." Below is a description of these rights...▪ Maintenance - living expenses. Living expenses can include the following:▪ Rent or mortgage▪ Groceries▪ Utilities (electric, gas, water, internet, cable)▪ Car insurance and gas
Cure - medical expenses. This covers everything related to the injury:▪ Emergency room▪ Follow-up doctor visits▪ Surgery▪ Radiology, x-ray or MRI▪ Physical therapy or chiropractic▪ Dental
When does maintenance and cure end?
